Frequently Asked Questions

  • How do I know if I have a case?
Every case is unique, and we believe clients are looking for an honest assessment of their case and the ways the case should advance forward. We prefer to meet with people one on one. We will discuss the strength of your case based on a liability and damages standpoint, and we will give you direction on how your case will go forward.
  • How is my case handled?
Roger Fuston personally handles each case and never sends them to another attorney to handle. Consistent communication is key — our team keeps in touch with our clients by phone, email and/or text. We understand that clients like to know how their case is developing, so we accept calls and emails throughout the process. If our firm doesn’t handle a specific area of practice, we’ll make sure you get a lawyer that is qualified to handle your case.
  • What is the value of my case?
The evaluation of your case is based on two things: liability and damages. Liability is the fault and strength of fault. Damages are medical bills, lost wages, pain, limitations, scarring and potential permanent injury. Both liability and damages must be accounted for and each area must be fully assessed.
  • How long will it take to resolve my personal injury case?
We attempt to move your case through legal process as quickly and effectively as possible. Phase 1 of the case is from date of incident through completion of treatment. Phase 2 is compiling all the relevant medical and damages evidence for your case. Phase 3 is the actual negotiations of your case once all medical and damages evidence is in hand. The point when a case will be evaluated is when you reach what physicians call maximum medical improvement (MMI). It is the point where you are released from your doctor’s care. Many times, we will then talk to your doctor to determine potential permanency or other issues of your injuries/case.
  • Can we stay in touch after the conclusion of my case?
Absolutely! Roger prefers to stay in touch with his clients about unrelated legal matters in the client’s life, changes in the laws, and personally as well. Roger is friends with many of his past clients and typically speaks with former clients every week.
